CVS Whistleblower Can Again Raise Copay Cards Kickback Claim - Bloomberg Law News

A whistleblower may again allege that CVS Health Corp. violated the False Claims Act by engaging in a kickback scheme involving the receipt of copay cards from government healthcare beneficiaries, an Illinois federal district court said.

The court in 2024 dismissed whistleblower Michael Gill’s claim for failing to adequately allege CVS improperly offered or paid something of value. But Gill may be able to show CVS violated the anti-kickback statute by accepting copay cards, and can raise that claim in a fourth amended complaint, Judge Steven C.
