Daimler Employee Fired After Flunking Pot Test Advances Lawsuit - Bloomberg Law

Daimler Truck NA LLC must face a worker’s claim that it violated New Jersey public policy by firing him for testing positive for marijuana he consumed recreationally two weeks prior to a workplace accident.

The US District Court for the District of New Jersey’s ruling Tuesday addressed the implications for employers and employees of a state law decriminalizing marijuana. Provisions of the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernizaiton Act make it unlawful to subject a worker to adverse employment action based exclusively “on the presence of cannabinoid metabolites in the employee’s bodily fluid.”
