Plaintiff, a Black man who worked at defendant law firm Davis Polk & Wardwell for four years, asserted that defendant and firm employees discriminated against him based on race by not including him on team-wide emails, giving him work outside of his focus area and removing him from projects.
Plaintiff added that when he began to complain about the discrimination, defendant retaliated against him by issuing negative performance reviews and reducing his hours. Plaintiff further argued that he was directly warned that if he did not stop complaining, he would be “out of the game” and “off the field,” which he viewed as a direct threat.
