Denny’s Inc. workers in Pennsylvania who allege the restaurant chain paid them sub-minimum wages in violation of state and federal law may proceed as a group on both claims, a federal court in the state said.
Juli Wintjen alleges Denny’s failed to properly notify employees it would claim a tip credit and pay them below-minimum wages, and also underpaid them even when they were required to do a significant amount of non-tip generating work, like cleaning.
