The Trump administration will no longer defend the US Department of Labor’s use of in-house administrative law judges in a lawsuit involving Comcast Corp., which sought to have whistleblower claims against the company heard in full court.
The Department of Justice has determined the “multiple layers of removal restrictions” for in-house judges are unconstitutional, according to a Tuesday filing in the District Court for the Eastern District of Virginia.
The change in position signals the new administration is more willing than previous ones to allow the courts to rein in the use of in-house judges by federal agencies.
