NYU and UPMC are the latest to strike deals with the DoJ over gender-affirming care as the Trump administration increasingly leverages fraud and billing law in its fight against the industry.
New York University Langone Hospitals (NYU) and University of Pittsburgh Medical Center (UPMC) have agreed to stop providing gender-affirming services to minors under new deals reached with the US Department of Justice (DoJ).
The agreements, announced last week (18 September), mark the latest chapter in the Trump administration’s fervent efforts to clampdown on what it describes as the “dangerous” provision of “sex-rejecting procedures” to children, which includes administering cross-sex hormones and puberty blockers and performing surgical procedures. Similar agreements have been reached with New York-based Mount Sinai Health System, Texas Children’s Hospital, the Cleveland Clinic Foundation and Connecticut Children’s Hospital.
NYU has agreed to pay $8.5 million to resolve the DoJ’s investigations into potential violations of federal law, which heavily centre on fraudulent billing practices and breaches of the False Claims Act. UPMC will pay a substantially lower penalty of $950,000. The hospitals have denied all allegations and no determination of liability has been made.
