The Justice Department filed a complaint under the False Claims Act against Capstone Diagnostics executives Jay Johnson and Austin Whiles, alleging they orchestrated two genetic testing schemes that caused Medicare improperly pay millions of dollars.
A Thursday press release said Johnson and Whiles used church-sponsored health fairs and religious conferences to generate genetic testing by directing Capstone personnel to swab attendees at mass events and then, without permission, using physician names, signatures, and standing orders to make the testing appear properly ordered.
