Domino's Faces Skeptical Ninth Circuit in Forced Arbitration Bid - Bloomberg Law

Two federal appeals court judges appeared hesitant to block a group of Domino’s Pizza LLC ingredient delivery drivers from pursuing their wage and hour class action, saying that judicial precedent foreclosed the company’s push to send the case to arbitration.

At issue before a three-judge panel of the US Court of Appeals for the Ninth Circuit Tuesday was whether the big-rig truck drivers qualify for the Federal Arbitration Act’s exemption for “contracts of employment of seamen, railroad employees, or any other class of workers engaged in foreign or interstate commerce.”
