Two DoorDash Inc. delivery workers must arbitrate their individual wage claims against the food delivery platform pursuant to a clause in the independent contractor agreement they assented to when they registered with the company.
It’s up to an arbitrator, not a court, to determine whether the workers’ individual wage-and-hour claims belong in arbitration, the US District Court for the Southern District of New York said. DoorDash can also enforce the section of the agreement waiving the workers’ rights to bring court claims on behalf of a class, the opinion said.
