The US Equal Employment Opportunity Commission urged a Texas federal court to affirm recent guidance addressing LGBTQ+ harassment protections in the workplace, saying it doesn’t constitute a final agency action that imposes direct legal consequences on employers.

The April guidance shouldn’t be vacated as requested by the State of Texas and Heritage Foundation because it doesn’t prejudge the outcome of a specific set of facts presented in a charge filed with the EEOC but attempts to clarity existing Title VII of the 1964 Civil Rights Act requirements, the agency’s said in its cross-motion for summary judgment Wednesday.
