Did You Know? On 18 June this year, it will be exactly 75 years since General de Gaulle broadcast his famous appeal on the BBC, urging the French to refuse capitulation and continue the fight against the Nazis. Note:
- June 18, 1940 – the original appeal was never recorded; only its text survives.
- June 22, 1940 – the only audio recording was made for posterity (its wording differs slightly from the 18 June text).
- July 2, 1940 – a filmed version was recorded for the cinematographic archives and is now available online.
A decision
Unsuccessful priority constitutional review (“QPC”) on the accrual of paid leave during work-related sick leave (Cass. soc., 28 May 2025 No. 25-40006)
In September 2023, the Court of Cassation set aside, in favour of EU law, the Labour Code provision limiting paid-leave accrual to one year during a work-accident or occupational-disease absence. To align with that ruling, Article 37 of Law No. 2024-364 (22 April 2024) removed the one-year cap—but without retroactive effect.
An employee seeking back pay for paid leave challenged the non-retroactivity of Article 37 via QPC; the Social Chamber declared the challenge inadmissible, noting the law post-dated her claim.
Implication: Confirms that retroactivity granted for non-work-related sick leave does not extend to work-related absences.
