Where a defendant employer violated the Massachusetts Wage Act by failing to pay a plaintiff’s contractually guaranteed salary, the employer’s misconduct in underpaying the plaintiff by $62,500 also constitutes a breach of contract.
“Dr. Amitabh Chandra was a member and an employee of Crow Point Partners, LLC. The company was founded by Peter DeCaprio and Timothy O’Brien, who together owned a majority interest in the company. Chandra claims that Crow Point, DeCaprio, and O’Brien breached his employment agreement and the Massachusetts Wage Act by not paying him his full salary, and then unlawfully retaliated against him and further violated his contract by firing Chandra for complaining that he was owed wages. Chandra also claims that DeCaprio and O’Brien breached their fiduciary duties to him by terminating his employment, and that DeCaprio and O’Brien tortiously interfered with Chandra’s contractual relationship with Crow Point.
“Defendants assert a counterclaim alleging that Chandra breached his contractual obligation to pay interest on a $150,000 loan.
“In its prior ruling on cross-motions for summary judgment, the Court held that Crow Point, as well as DeCaprio and O’Brien personally, are liable to Chandra under the Massachusetts Wage Act for failing to pay his contractually-guaranteed salary while Chandra was employed by Crow Point.
