Where a plaintiff has brought suit over her employment as a postdoctoral researcher in the University of Massachusetts Microbiology Department, the complaint must be dismissed because the claims arising out of the plaintiff’s employment at UMass-Amherst in 2014 and 2015 are untimely and fail to state a claim upon which relief may be granted.
“Jane Doe (‘Plaintiff’), proceeding pro se, brings this action against various defendants arising out of her employment in 2014 and 2015 as a postdoctoral researcher in the University of Massachusetts Microbiology Department as well as events which transpired thereafter. Defendants have filed motions to dismiss Plaintiff’s operative complaint — her Third Amended Complaint (‘TAC’) — asserting her claims are untimely and fail on the merits. In addition, Plaintiff has filed a motion for leave to file a fourth amended complaint. For the following reasons, the court concludes that Plaintiff has failed to state a claim upon which relief may be granted and that her proposed fourth amended complaint is futile. Accordingly, the court will grant Defendants’ motions to dismiss and deny Plaintiff’s motion for leave to file an amended complaint. …
