Employment Rights Bill: latest round of consultations - Dentons

The latest consultations on measures proposed in the Employment Rights Bill (the Bill) give employers an opportunity to influence the practical detail. These consultations cover:

  • the duty to inform workers of their right to join a trade union;
  • the trade union right of access to workplaces;
  • bereavement leave, including for pregnancy loss; and
  • enhanced dismissal protections for pregnant employees and new mothers.

Duty to inform workers of their right to join a trade union

The Bill will create a statutory duty on employers to provide employees with a written statement informing them of their right to join a trade union. Employers must provide this information at the same time as the employee receives their written contract of employment and potentially at "other times" too.

The consultation seeks views on:

  • whether the government should publish a standard statement or employers should draft their own statement in line with the mandated content requirements;
  • what employers should include – the government proposes a brief overview of trade union functions, a summary of employees' statutory rights in relation to union membership and a list of any trade unions recognised by the employer;
  • how employers should deliver the statement – for example, directly to employees by email or letter, or indirectly via the staff intranet; and
  • how frequently employers must re-issue the statement – the government proposes annual

    re-issue to existing workers, together with annual reminders.
