An Illinois federal judge allowed a proposed employee class action genetic privacy lawsuit against a California-based seafood company to proceed, denying its request either to dismiss the case or send it to arbitration.
Anita Ginski alleged Ethos Seafood Group LLC violated the Illinois Genetic Information Privacy Act when the company asked her and others similarly situated, as a precondition to employment, to answer questions concerning family medical histories, including whether any family members had a history of high blood pressure and other medical conditions, Judge Mary Rowland of the US District Court for the Northern District of Illinois said.
