A marketing expert hired by a Utah Indian tribe to promote development of the mineral resources on its reservation is unable to pursue his breach of contract suit against the tribe in state court, the Tenth Circuit said Thursday.
Lynn Becker filed his suit in a Utah court, saying that the Ute Indian Tribe of the Uintah and Ouray Reservation reneged on its agreement to pay him 2% of specified revenues for his work. The tribe filed for a preliminary injunction in federal court, arguing that the suit could only be heard in tribal court.
