Exatech Agrees to Pay $8 Million in Two FCA Whistleblower Suits - Bloomberg Law News

Medical device company Exactech Inc. agreed to pay $8 million to resolve allegations that it violated the False Claims Act by knowingly submitting or causing false claims for payment to Medicare, Medicaid, and the Department of Veterans Affairs for defective knee-replacement devices.

The settlement resolves claims that Exactech sold defective finned tibial tray components and polyethylene components used in certain knee replacement systems, despite knowing they failed at higher than acceptable rates.

The Florida-based company allegedly continued marketing and selling these defective components for knee surgeries on government beneficiaries between 2008 and 2022.
