Ahmedabad: The Gujarat high court upheld a divorce granted by a family court on the grounds of cruelty by the wife, who made false allegations that her mother-in-law tried to force her into prostitution.
The quarreling couple in this case were from Morbi. The wife left her matrimonial home two months after marriage in Sept 2015. She then filed a complaint under the Domestic Violence Act and lodged a police complaint under Section 498A of the IPC, alleging cruelty against her husband, mother-in-law and other relatives.
In 2021, the husband approached the Morbi family court for divorce on the grounds of cruelty and desertion.
In April 2022, the family court granted him divorce, and the wife challenged the order in the high court. She contended that she was ready to return to her matrimonial home, but the husband was not willing to accept her because of the criminal complaint she had filed.
The husband submitted before the high court that the wife levelled allegations against the mother-in-law, claiming she forced her into prostitution.
However, it was proved in the family court that the allegation was without any substance and made with the intention to damage the family's reputation in society.
