A jury must decide whether Federal Express Corp. failed to fulfill its obligations under federal disability discrimination law when it didn’t offer a package handler additional job-protected leave to recover from shoulder surgery, a Manhattan federal judge ruled.
According to the company, Ramon Cayetano never asked for more leave to accommodate his lifting restrictions when the job-protected time off he was guaranteed under the Family and Medical Leave Act expired. Because Cayetano still couldn’t meet the 75-pound lifting requirement of his position, he couldn’t perform his essential job functions, the company said.
