HOLBROOK – The federal Department of Labor is suing a Holbrook tree service over allegations that he failed to pay $82,122 in overtime to eight employees and threatened a teenager who he feared cooperated with investigators.
The Department of Labor filed the lawsuit in federal court on Wednesday against PS Tree Service and owner Ronan De Souza, along with a joint request to a judge to approve a settlement in the case.
Between April 2018 and April 2021, De Souza failed to pay his employees time-and-a-half when they worked more than 40 hours in a single week and instead payed them their normal hourly rate, adding up to $82,122, according to federal court documents.
The amounts owed to each employee ranged from a high of $29,542 to a low of $780. Under a proposed settlement agreement, those employees would receive unpaid overtime and damages equal to the amount of unpaid overtime, increasing the payouts by up to $59,085.
Under the proposed settlement agreement, De Souza would owe his employees a total of $164,245 and pay an additional $3,907 fine to the federal government. He would also be required to keep proper records of employees' hours in the future, and not break federal labor law again.
