The Fifth Circuit, in a certified question on Friday, asked the Louisiana Supreme Court if the reach of environmental whistleblower protections under state laws extends to an employee who refused to engage in an illegal activity.
Employee Kirk Menard alleged that Targa Resources LLC violated the Louisiana Environmental Whistleblower Statute by discharging him after he refused, and reported, a manager’s directive to dilute sewage samples to cover up that the total suspended solids in water samples exceeded regulatory limits.
