Fifth Third Bank Wins Dismissal of Whistleblower's Fraud Suit - Bloomberg Law

Fifth Third Bank N.A. won dismissal of a whistleblower’s suit alleging the submission of false claims for payment to the Federal Deposit Insurance Corp. under a 2010 shared-loss agreement, a New York federal court said.

FDIC became a receiver for Chicago-based Broadway Bank in 2010 after a series of bad loans, and accepted MB Financial’s bid for Broadway’s assets, the court said. FDIC allegedly entered into a shared-loss agreement with MB Financial under which FDIC agreed to assume 80% of future losses MB Financial incurred on Broadway’s loans.
