A Glendale Fire Department captain has settled his lawsuit against the city, in which he alleged he was demoted and suffered other retaliation when he objected to the chief’s alleged order to use state-funded fire engines intended for fighting brush fires to handle routine calls.

The accord was revealed in a minute order prepared Friday by a clerk for Los Angeles Superior Court Judge Malcolm Mackey, who presided over the case. No terms were revealed.

In his whistleblower suit filed in August 2020, Murphy said he joined the GFD in October 1997 as a firefighter and worked his way up to captain in 2013. In March 2019, he was promoted to battalion chief on a one-year probationary term in anticipation of being appointed permanently to the position, according to his court papers.

In their court papers, lawyers for the city maintained Murphy failed while on probation, that he was not subjected to retaliation and that the actions taken against him were for “legitimate, non-discriminatory” reasons.

Murphy was responsible for the Verdugo Communication Center’s area C, which includes Burbank, Glendale, Monrovia, Pasadena, Arcadia, Sierra Madre, San Gabriel, Monterey Park, Alhambra, Montebello and the Hollywood Burbank Airport, the suit stated.
