Fire Chiefs File Suit Against Virginia City Over Exempt Status - Bloomberg Law

A group of firefighters in Northern Virginia claim that the City of Alexandria violated the Fair Labor Standards Act and state wage law by misclassifying them as exempt from overtime pay, according to a lawsuit recently filed in federal court.

The lawsuit was brought by Anthony Kelly and nine other individuals employed as either Operational or Administrative Battalion Chiefs for the Alexandria Fire Department.

The city requires OBCs to work 24-hour shifts where they alternate between being “on duty” and “off-duty” during a 28-day work period, which amounts to 212 hours, the complaint says. When they’re on duty, they’re expected ...
