A former First Data Technologies Inc. call center representative with a bad back raised triable questions on whether her disability caused her to be fired, not her performance issues, a divided Fourth Circuit ruled Friday.
The company says it terminated Terri Cowgill after more than 10 years because she violated its policy on call avoidance. It put her on an improvement action plan following an incident in July 2015 and less than a month later another customer submitted a negative survey regarding Cowgill, complaining that she prematurely disconnected their call, according to First Data.
