An abitration provision in a rewards program agreement covers a man’s false-ad claims against makers of GNC brand “Triple Strength Fish Oil,” a California federal court said, granting a motion to compel arbitration by International Vitamin Corp. and its Nutra Manufacturing LLC unit.
John Gatto alleged the “fish oil” descriptor was deceptive because the companies used a processing method that removes fish oil’s essential fatty acids, which are desired for health benefits.
Gatto purchased the supplement from a GNC store using his GNC Program rewards membership.
