PRESTONSBURG, Ky. (WYMT) - A former employee of the Floyd County School District filed a whistleblower lawsuit against the Board of Education Thursday, claiming he was fired for reporting crimes against children.
Thomas Gearheart, the former Chief Safety Officer for Floyd County Schools, is suing the board of education for wrongful termination, claiming he was fired on May 14, 2026, as retaliation for reporting misconduct, cooperating with police, and preparing to testify before a grand jury.
Gearheart claims the school board deliberately excluded him from an investigation into a school bus driver who allegedly sexually assaulted a minor female passenger. He raised concerns that the board’s delays allowed the bus driver to delete evidence from his cellphone before Prestonsburg Police became involved.
The lawsuit names Superintendent Tonya Horne-Williams as a defendant. Gearheart claims Williams retaliated against him by relocating his office after he worked behind school board officials to file a report with Kentucky State Police, after he “became aware of an incident involving a minor child and allegations that the child had exposed herself to an adult male through the use of a cellular device while on a school bus.”
