Fred Meyer Worker Wins Bid to Send Wage Case Back to State Court - Bloomberg Law

A Fred Meyer Stores Inc. worker can pursue proposed class wage-and-hour claims in state court after the supermarket chain failed to show there was enough money at stake to keep the case in a federal forum.

The Kroger Co. subsidiary invoked the Class Action Fairness Act to remove the worker’s state court suit, alleging state law violations, to federal court. But Fred Meyer hasn’t shown that there’s more than $5 million in controversy, so it hasn’t met CAFA’s requirements for removal, the US District Court for the Western District of Washington said.
