Ga. Firefighter Asks 11th Circ. To Revive Whistleblower Case - Law360

By Kelcey Caulder (April 25, 2022, 7:40 PM EDT) -- A Georgia firefighter has asked the Eleventh Circuit to revive his case against his employers in a metropolitan Atlanta county, who he claims retaliated against and demoted him after he spoke out about safety concerns related to staffing shortages in the fire department. In an appeal filed Friday, Scott Millspaugh, a Cobb County firefighter since 1996, argued a federal district court wrongly held he engaged in speech as an employee, not a citizen, when he left County Commissioner Keli Gambrill a voicemail reporting what he saw as a potentially dangerous shortage of firefighters. Millspaugh also argued the district court was wrong. . .
