A handful of Georgia attorneys have secured a $13.75 million settlement for the federal government and their client, a Florida man who blew the whistle on a kickback scheme regarding Cologuard, an at-home colon cancer-screening test.
The settlement was obtained under two federal laws: the False Claims Act (FCA) and the Anti-Kickback Statute. The plaintiff, Dr. Niles Rosen of Winter Park, Fla., filed a qui tam lawsuit on behalf of the United States in the U.S. District Court for the Middle District of Florida in Tampa against Exact Sciences, the Madison, Wisc.-based healthcare company that owns Cologuard.
