Government Accountability Project Whistleblower Disclosures Featured in Motion to Intervene in Federal Consent Decree with Norfolk Southern

WASHINGTON—Today, Government Accountability Project announced that critical whistleblower evidence documenting ongoing toxic contamination in East Palestine, Ohio is now—for the first time—before a federal judge. This marks an important step toward transparency, accountability, and improved health protections for a community still suffering nearly three years after the Norfolk Southern train derailment and chemical burn. This evidence has been brought forward following the filing of a Motion to Intervene submitted by attorney Jedidiah I. Bressman of Keenan Law on behalf of residents Robert Figley and Barbara Adams.

For more than two years, Government Accountability Project has conducted independent investigative work in East Palestine, gathering scientific evidence, whistleblower testimony, Freedom of Information Act (FOIA) documents, and sworn community health declarations. Although Government Accountability Project previously provided this evidence to the U.S. Department of Justice (DOJ) and the Ohio Attorney General (AG), the filing marks the first time key whistleblower-supported evidence has formally entered the court record in the federal Clean Water Act and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) enforcement case against Norfolk Southern (Case No. 4:23-cv-517).
