Take-Two Interactive Software Inc. and subsidiaries Rockstar Games Inc. and 2K Sports Inc. lost their bid for about $9 million in attorneys’ fees and costs after a Delaware federal judge agreed that their video games Grand Theft Auto Online, NBA 2K15, and NBA 2K16 don’t infringe a handful Acceleration Bay LLC patents covering online play.
Although Take-Two escaped the infringement allegations, Delaware federal Judge Richard G. Andrews disagreed that Acceleration Bay’s conduct—including what Take-Two described as a doctored video game frame presented as evidence and long-shot arguments—were so egregious that they warrant a payout of attorneys’ fees.
