Hamilton-Ryker IT Assessed $160K in Attorney's Fees in FLSA Loss - Bloomberg Law

Staffing and recruiting company Hamilton-Ryker IT Solutions LLC should be on the hook for $160,000 in attorneys’ fees in a Fair Labor Standards Act case involving workers placed at Freeport LNG Expansion LP, a federal magistrate judge said.

US Magistrate Judge Andrew M. Edison of the US District Court for the Southern District of Texas made the recommendation a year-and-a-half after the court granted summary judgment to the plaintiffs, Marc Taylor and the estate of Terry Gentry.

Counsel for plaintiffs had requested $194,730 in attorneys’ fees. Edison recommended Monday that the amount be trimmed to eliminate recovery for duplicative work, clerical tasks, and travel time.

Gentry worked for H-R IT as a senior control systems engineer assigned to Freeport from June 1, 2015, until March 13, 2019. H-R IT assigned Taylor to Freeport as lead electrical engineer on Aug. 28, 2017.

It was undisputed that Gentry and Taylor worked more than 40 hours each week. And H-R IT failed to show that the workers were exempt from the FLSA’s overtime provisions as “highly compensated” or “learned professional” employees, the court said in its earlier ruling.

The court previously awarded the Gentry estate $28,659, and awarded Taylor $66,900.

The US Court of Appeals for the Fifth Circuit affirmed the liability finding and awards on July 24.
