‘Hasn’t sunk in yet’: Melbourne doctor wins landmark wage theft case - Sydney Morning Herald

A young Victorian doctor has won a wage theft case against Peninsula Health, a victory lawyers say will set a precedent for thousands of junior doctors across Australia fighting for hundreds of millions of dollars in unpaid compensation.

The Federal Court on Friday ruled Peninsula Health breached Fair Work legislation by not paying Dr Gaby Bolton for overtime she worked during four rotations as a junior doctor at Frankston Hospital in 2019 and 2020.

“It really hasn’t sunk in yet, but I am hoping it is the beginning of some change,” Bolton told this masthead.

Bolton, 29, was awarded $8345 as lawyers prepare for a string of class action cases against Australia’s hospitals over the “systemic and widespread” underpayment for junior doctors, including some claims of up to $50,000 in unpaid wages.

She was the lead applicant for a lawsuit representing a group of young doctors who worked for the health service in Melbourne’s south-east.

Bolton hoped her win would become a catalyst for her colleagues and put an end to trainee doctors working dangerous hours.

There are 15 other class actions lodged against nine Australian health services, including Alfred Health, St Vincent’s Hospital, Western Health and Monash Health in Victoria.
