HC imposes ₹1L cost as GST fraud accused pose as whistleblowers - Times of India

Ludhiana: The Punjab and Haryana high court has dismissed a petition for anticipatory bail and imposed a cost of Rs 1 lakh on two petitioners who posed as whistleblowers while concealing their status as partners of an accused involved in a fraud of hundreds of crores of rupees, unearthed by the CGST commissionerate, Ludhiana.
The petitioners had also sought transfer of the case from CGST department against them to other agencies like CBI. The court has ordered them to deposit the cost imposed on them with the Punjab and Haryana high court bar association advocates welfare fund.
Sources said the petitioners had filed petitions to derail the investigation and save themselves from the action being taken by CGST Ludhiana after their involvement was found in a racket of running bogus billing and availing fraudulent input tax credit (ITC).
In its orders issued on March 15, the court of Justice Arvind Singh Sangwan said, “After hearing the counsel for the parties, I find no merit in the petitions for anticipatory bail filed by the petitioners as well as in the petition seeking direction to transfer the investigation of the case to an agency like CBI/CVC as in both the petitions, the petitioners have deliberately concealed their status of being an active partner of main accused Baljinder Singh and having created four firms, i.e. two firms by petitioner No. 1 (Manjit Kumar) — RNG Traders and Raj Enterprises — and two other firms by petitioner No. 2 — Deep Enterprises and Diksha...
