Herbster formally files lawsuit against Sen. Slama, others - Siouxland News

On Friday, gubernatorial candidate Charles Herbster filed a legal complaint against State Sen. Julie Slama, accusing her of a politically-motivated attack, including false and malicious lies.

Herbster's office issued a statement, saying, in part:

"Our legal system is based on a presumption of innocence. Trial by media and public opinion strips the protections granted to all citizens by our constitution. It is not a coincidence that the accusations which are the subject of the lawsuit were made just days before an election."

Slama is one of eight women included in a story the Nebraska Examiner published last week, who accuse Herbster of sexual assault.

Herbster said earlier that his team was sending out legal holds to Slama, opponent Jim Pillen and Gov. Pete Ricketts.

Lawyers tell Fox 42 that this is just beginning preparations.

"They want to make sure all evidence is preserved," Berry Law Firm partner John Berry said. "This is standard. You would expect any attorney to do this, to look at who all the potential defendants could be in a case, and then send out litigation holds."

The three targets of the legal holds bear significance.

"They infer that the person who sent the demands to hold the evidence is interested in finding out whether there are communications between or among the people in that trilogy and, if there are, whether they prove a conspiracy to try to defame the person," said David Domina, partner at Domina Law Group.
