High Court Rules on Federal Arbitration Act's Application to California PAGA Claims - SHRM

The U.S. Supreme Court clarified on June 15 whether the Federal Arbitration Act requires enforcement of an arbitration agreement providing that an employee cannot raise claims under the California Private Attorneys General Act. The court found that companies are entitled to compel arbitration of an employee's individual claims.

"PAGA provides no mechanism to enable a court to adjudicate nonindividual PAGA claims once an individual claim has been committed to a separate proceeding," the Supreme Court stated.
