Reform of the Italian Civil Procedure: new regulations in labour law-related proceedings

It is well known that the Italian procedural system may have some critical issues. Pursuant to the Delegation Law of 26 November 2021, no. 206, the Italian Government has been entrusted to adopt one or more decrees to reform the Italian Civil Procedure System in the next year. The objectives to pursue have been the same for years: to lighten the excessive load of proceedings and respond to the need for speed and efficiency to ensure effective judicial protection. As part of the reform, also the labour law procedural system will be affected by some changes. Among those, two major changes regard the introduction of the assisted negotiation procedure for labour matters and the abolition of the current dual-track system to challenge dismissals.

ADR: Settlement agreement with the assistance of the lawyers only.

One of the main changes concerns the possibility to settle labour-related matters only with the assistance of lawyers. According to Section 2113 of the Italian Civil Code employees’ rights such as outstanding remuneration of any kind, bonuses, reimbursement for expenses, indemnities, damages and so on, cannot be waived under private agreements. Said waivers and transactions can be challenged within six months from the date of termination of the employment relationship or from the date of the waiver or the transaction in case the latter ones occur after the employment termination....
