Hinckley Allen team makes history with $34.5M whistleblower recovery - Massachusetts Lawyers Weekly

A team of Hinckley Allen lawyers recently brought home a record-breaking $34.5 million settlement in a Sarbanes-Oxley Act whistleblower retaliation suit.

The plaintiff, Carlos Domenech Zornoza, is represented by James L. Tuxbury, Christopher V. Fenlon, Michael J. Connolly and Janelle A. Pelli. The March 20 settlement in Zornoza v. Terraform Global, Inc. is the largest documented recovery in a SOX whistleblower retaliation case, according to Tuxbury, who practices out of Hinckley’s Boston office.

Calling it a “substantial, heavy case” with issues involving fraud and employment and securities law, Tuxbury says he and his colleagues were prepared from the get-go to try the case.

“At every turn, at every fight, at every dispute, and at every blockade, it was always a matter of: ‘What do we need for trial?’” he says.

In a statement announcing the settlement, Fenlon, a partner in the Albany, New York, office, said the court’s finding of liability in favor of the plaintiff represented “a landmark moment in whistleblower protection law,” underscoring the importance of protecting employees who raise concerns about corporate misconduct and reminding the boards of publicly traded companies that “SOX is alive and well.”

The nine-year legal battle was noteworthy apart from the final number, according to Boston-based Connolly.
