Home Depot U.S.A. Inc. and workers who say it owes them wages for improperly rounding down their recorded time each won partial summary judgment in federal court in Oregon.
The workers are correct that Oregon law doesn’t authorize the Home Depot Inc. subsidiary’s rounding policy and the de minimis doctrine doesn’t apply to the unpaid time, the US District Court for the District of Oregon said. However, the home improvement chain established that it didn’t willfully violate wage-and-hour law, the court added.
