A Hawaii hospice provider partially prevailed in a lawsuit brought by an employee who refused to take a Covid-19 vaccine while pregnant.
Lacy Fecher, who’d been placed on administrative leave, hadn’t administratively exhausted her sex and pregnancy bias claims as required by the Hawaii Employment Practices Act, the US District Court for the District of Hawaii said. She also failed to state a claim under the state’s whistleblower protection law, it said.
