An Illinois Tool Works Inc. buyer who was terminated during its restructuring will have her age discrimination claim heard by a jury, a Kansas federal court ruled.
Debra Fullington presented sufficient evidence for a jury to find that ITW’s restructuring was pretext to fire her because of her age, the US District Court for the District Court of Kansas ruled Oct. 7. Because there is genuine dispute about the reason for her termination, a jury must weigh the evidence, the court said.
