Immunity Waiver by Road Work Lane Shift Mulled by Texas Justices - Bloomberg Law

The Texas Supreme Court heard arguments Thursday in a case that could further delineate the line between agency acts that are and aren’t protected by the state’s sovereign immunity law.

Daniel K. Christ and Nicole D. Salinas, who were injured in a road construction zone traffic accident, sued the state’s Department of Transportation, saying the agency failed to follow the law of only allowing modifications to a traffic plan with an engineer’s statutorily required seal.
