Whistleblowers are set to be better protected across the EU. That is why the EU Whistleblowing Directive entered into force on December 16, 2019.
The Directive requires all companies with more than 250 employees to establish a whistleblower compliance reporting system by no later than December 17, 2021. Smaller companies with 50 to 250 employees have until December 17, 2023 to establish such a system.
Germany also intends to enact a corresponding whistleblower protection law. The legislative process has now come to a standstill, however, due to differences of opinion within the governing coalition.
The German Whistleblower Act is expected to enter into force soon – at the latest at the beginning of the next legislative period. Otherwise, Germany faces the threat of infringement proceedings. The reporting systems should therefore be in place by the end of the year. Anyone who misses this deadline risks severe sanctions. In addition, employees may be able to invoke the EU Directive directly if the transposition deadline expires without results, which may also lead to risks for companies.
