SDNY COURTHOUSE, Sept 6 – The pharmacy chain Omnicare is the subject of a "qui tam" case unsealed four years ago. It is still in discovery.

On September 6, 2022, U.S. District Court for the Southern District of New York Judge Colleen McMahon held a status conference. Inner City Press covered it.

The case was unsealed in 2019, and the District of Columbia at that time file a notice of intent to intervene. The Relator is a licensed pharmacist, accusing Omnicare of dispensing prescription or "legend" drugs without valid prescriptions. He sued under the False Claims Act.

Judge McMahon said, more than once, that the March 1, 2023 deadline for all discovery "will not be changed unless I die... in which case a new judge will be assigned and you can try to convince them."

There was initial agreement that this "short leash" might be necessary - but then more reasons for delay for the data. Judge McMahon said, You have been diddling. And so, the deadline is set.

The case is US ex rel. Uri Bassan, et al v. Omnicare, Inc. 15-cv-4179 (McMahon)
