ITS Logistics and a potential class of truck drivers who allege that it violated California wage-and-hour laws should try again to settle their lawsuit, a federal magistrate judge said.
Keith Guthrie alleged on behalf of a class that ITS underpaid them, refused to provide meal and rest breaks, didn’t reimburse expenses, and violated other state laws.
The parties agreed last year to settle the claims for $365,000, with class counsel getting over $87,500 in fees, leaving class members about $218,500.
