A whistleblower at a private IVF clinic was wrongfully sacked for complaining that patients were being misled about success rates, a tribunal found.
Ann Henderson was seen as a “problematic colleague” by her boss and ousted from her job for persistently flagging troubling issues at the clinic she was lab manager at.
The IVF expert repeatedly warned of an “unacceptably high level of risk of errors” at the clinic due to staff shortages, lack of staff skill, and a workload which was too high, the hearing was told.
Ms Henderson insisted that hopeful parents were at risk and were being “misled” over success rates, the tribunal heard.
However, Mark Tomnay, the commercial director at UK-wide TFP Fertility, did not want to deal with her escalating concerns as it would “impact negatively on patient numbers and therefore income”, the hearing was told.
Instead, Ms Henderson was squeezed out from her job at TFP GCRM Glasgow Fertility Clinic, which is Scotland's only private fertility clinic.
Ms Henderson, who qualified in 1995, is now in line to receive compensation after successfully suing GCRM for whistle-blowing detriment and unfair dismissal.
'Did not work harmoniously or with much respect'
TFP took over the Glasgow clinic in 2018 when it was owned by Nuffield. Ms Henderson had been lab manager there since 2003 and was the most senior embryologist.
