ABM Industry Groups LLC must face wage-and-hour allegations in state court after a judge determined there’s no subject matter jurisdiction supporting the company’s removal of the suit to a federal forum.

A worker filed the proposed class action accusing the janitorial services company of violating California employment laws. ABM removed the case to a US court, but federal labor law doesn’t preempt the state-law claims, the US District Court for the Central District of California said Monday, remanding the matter.
