J&J Unit Targets $1.6B False Claims Award
A J&J unit will try to convince the Third Circuit to throw out a verdict — and a record $1.6 billion judgment — seeking to hold it responsible for submitting nearly 160,000 false claims to the government through antiviral drug promotions, Daniel Seiden reports.
The case could force the appeals court to consider whether whistleblowers filing lawsuits against alleged fraudsters on the government’s behalf is constitutional. In this case, two whistleblowers sued in 2012, alleging that Janssen Products’ off-label drug promotion misled doctors, making the company’s reimbursement claims false.
