Judge dismisses nurse's whistleblower suit over alleged Medicare billing scheme - Yahoo

A federal judge has dismissed a whistleblower lawsuit brought by a nurse who alleged that San Antonio's Gonzaba Medical Group and two of its leaders engaged in a scheme to inflate Medicare payments through fraudulent billing practices.

Gayle Traver's claims against San Antonio's WellMed Medical Management Inc. and parent company UnitedHealth Group Inc. also were dismissed this week by U.S. District Judge Jason Pulliam, who entered a final judgment in the case. The lawsuit alleged WellMed received diagnosis data from providers including Gonzaba Medical.

The defendants had argued that Traver's complaint should be dismissed because she didn't spell out her allegations with enough detail, as required by federal court rules.

The dismissal came after Traver filed a third amended complaint.

Pulliam said that the complaint lacked the specific details required to plead fraud under federal rules and failed to adequately allege that any defendant knowingly submitted false claims.

The allegations were "too nebulous and unsupported by specific factual detail," the judge wrote in his 38-page opinion.

Arvind Khurana, a New York lawyer representing Traver, did not immediately respond to a request for comment, so it's unclear whether she intends to appeal Pulliam's ruling.

Representatives for the defendants also did not immediately respond to a request for comment.
